New 3DS XL wont turn on. Black screen.

I purchased a New 3ds XL on Friday February 26th 2016 so that i could buy the pokemon red and yellow virtual console games on the eshop on the 27th.

I completed a system transfer from my old 3DS XL transfering my pokemon back apps, pokemon dream radar and a digital copy of The legend of Zelda: a Link between worldsonto the brand new system that i just purchased and got out of the box.

The next day on February 27th 2016 i purchased pokemon red and pokemon yellow from the eshop and downloaded them onto the new 3ds xl. I played on the system for a fair amount of time taking breakes every now and then.

Later that day i saved my game on pokemon red and clicked the home button to go back to the home screen, I then clicked back onto pokemon red to resume the suspended software and my screen froze on the home screen and the game didnt resume and the music continued playing. The touch screen didnt respond and the buttons, dpad and circle pad didnt move the selected box so the system has completely froze other than the default homescreen music playing.

i held down the power button and forced the system to shut down. I tried restarting it straight away and when pressing the power button, the blue LED lights up and the screens dont turn on, there is not sound and the wireless communication LED doesnt light up. When i plug the system into the AC Adaptor the charging light comes on to indicate that the system is charging but when i try and turn it on i have the same problem every time.

The blue power LED lights up and nothing else happens. i can hold the power button for around 10 seconds and the system turns off and the blue light goes off but other than that by system doesnt do anything.

I am very upset that i have had this system for about 1 day and it seems to have broken. i have never had this happen with any other ds systems that ive used in the past.

I am also upset that i purchased 2 eshop games as well as transfered all of the other games and save data from my old 3ds onto this new one and now i cant play them or use any of my software.

my main concern is that if i send it away to be repaired by nintendo, i may lose the games that i have purchased on the eshop of the 3ds. if this is the case then i will strongly demand better service because i am very disappointed that a 1 day old system can break as quickly as it did for literally no reason at all.

if anyone has any information on this issue i would greatly appreciate it.
